Implexity Designs, LLC is a small (read: tiny) me-tailing business driven by a creative conquer-from-home Appalachian soccer mom. It specializes in designs that celebrate cosplay and geeky fandoms.

Implexity Designs makes use of stock images for some of its designs. The vast majority of these images are legally licensed through royalty-free stock image shops (including, but not limited to Deposit Photos, CanStock Photo, and Dreamstime). In some instances, however, images were obtained from free stock sites (including, but not limited to SXC and All-Free-Download). Given recent revelations that these free sites may not be on the up-and-up, Implexity Designs is currently attempting to purge its listings of all designs that use free stock in whole or in part.

When Implexity Designs launched in 2010, its owner was unaware of the need to reference all sources. (Mea culpa.) As part of the business' updated operating procedures, an effort is now underway to add source citations to all listings that make use of such images. It will take a considerable amount of time to complete this task. New listings, however, will have such citations as a matter of course.

If any party believes a design to infringe on their copyright, they are encouraged to contact Implexity Designs pursuant to the NOTICES AND PROCEDURES outlined below. Thanks for your patience and understanding.

TERMS OF USE

Implexity Designs, LLC offers its original and derivative artwork for personal use only. The use of Implexity Designs images for commercial purposes is a violation of these terms. Uploading, sharing, or selling Implexity Designs’ digital images is also a violation of its copyright.

For example, making a fabric created from an Implexity Designs image available for public purchase is a violation of both copyright and terms of use.

However, creating physical products from fabrics that are privately created using Implexity Designs images is an acceptable use from Implexity Designs’ perspective. Customers should be aware that the fabric printer may not share this view.

Further, Implexity Designs reserves the right to exclusively sell its images on products offered by online vendors including, but not limited to: CafePress, Zazzle, and Spreadshirt.

Implexity Designs will consider requests to make exceptions to its terms of use on a case-by-case basis and may require inclusion of copyright notices and reciprocal links at the point of sale.

NOTICES AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT
Pursuant to the Digital Millennium Copyright Act, 17 U.S.C. Sec. 512, Implexity Designs will explore notices of claimed copyright infringement. If you believe in good faith that your work has been copied in a way that constitutes copyright infringement, you may provide Implexity Designs the following information via email:

• A description and link to the copyrighted work that you claim has been infringed;
• A link to an Implexity Designs product where the material that you claim is infringing is located on the Internet;
• Your legal name, mailing address, telephone number, and valid e-mail address;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and
• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

United States law provides significant penalties for submitting such a statement falsely.

Upon receipt of such notices, Implexity Designs will determine a course of action that may include removal of alleged infringing material. Claimant will not be contacted unless additional information is required. Implexity Designs reserves the right to make a counter claim asserting its legal right to use the alleged infringing material.
